Terms of Enrollment and Website Use
1. About Creatiminds and Acceptance of Terms
Creatiminds is a learning initiative operated by Markmydigi Technologies. Throughout these policies, “Creatiminds”, “we”, “us” and “our” refer to Markmydigi Technologies and the Creatiminds program, as applicable.
By accessing the website, submitting an enquiry, booking a trial, paying a fee, creating an account, or enrolling a child, the parent or lawful guardian confirms that they have read, understood and agreed to these Terms, the Privacy and Child Data Policy, the Refund, Cancellation and Batch Transfer Policy, the Child Safeguarding and Online Safety Policy, and any program-specific information shown before payment.
A child must not independently purchase a program, accept these Terms, provide payment information, or create an account that requires legal consent. Where a child accesses learning content, such access is authorised and supervised by the parent or lawful guardian.
2. Eligibility and Parent/Guardian Authority
Creatiminds programs are primarily designed for children aged 8–14. Individual programs may have narrower age, grade, language, skill or prerequisite requirements, which will be disclosed on the relevant program page.
The enrolling adult represents that they are the child’s parent, lawful guardian, or a person duly authorised by the parent or lawful guardian. Creatiminds may request reasonable verification of this authority, particularly for child-data consent, authorised pickup, media permission, emergencies or disputes.
Creatiminds may decline or postpone admission when a program is not age-appropriate, capacity is full, required consent is missing, safety concerns exist, or the program cannot reasonably meet a learner’s disclosed support requirements. Such decisions will not be based on unlawful discrimination.
3. Program Information and Enrollment
Program pages, brochures, counselling calls and admission messages describe the intended curriculum, duration, schedule, format, fees, inclusions, exclusions and expected learner commitment. Final enrollment is confirmed only after the required payment and forms are completed and Creatiminds issues written confirmation.
Parents must provide accurate and complete information. Creatiminds may correct obvious website errors, typographical mistakes, scheduling conflicts or pricing errors before confirming enrollment. If a material correction affects a confirmed enrollment, the parent may choose the corrected offering, an available alternative, a credit, or a refund of the affected amount.
Batch size, instructor allocation, learning platform, venue, session timing and module sequence may be reasonably changed for educational, safety, operational or availability reasons. Material changes will be communicated in advance where practicable.
4. Fees, Taxes and Payment
Fees must be paid through the payment methods displayed or expressly approved by Creatiminds. The parent is responsible for ensuring that payment details and billing information are accurate and that they are authorised to use the chosen payment method.
Any registration fee, instalment plan, taxes, payment-gateway charge, material cost, event fee or optional add-on will be separately disclosed before payment. Creatiminds will not treat a pre-ticked box, silence or inactivity as consent to purchase an optional service.
Where instalments are offered, access may be paused after reasonable notice if an instalment remains unpaid. Pausing access does not automatically cancel amounts already due. Refunds and transfers are governed by the Refund, Cancellation and Batch Transfer Policy and applicable law.
Parents should retain invoices, receipts and payment confirmations. Creatiminds will not request card PINs, OTPs or full banking passwords through calls, email or messaging applications.
5. Trials, Promotions, Scholarships and Discounts
Trial sessions may differ from regular sessions in duration, batch size, instructor or content. A trial is intended to demonstrate teaching style and program fit and is not a guarantee of a particular instructor, outcome or final batch composition.
Discounts, coupons, scholarships, referral benefits and promotional offers are subject to their published eligibility, validity and usage conditions. Unless expressly stated, offers cannot be combined, transferred, exchanged for cash or applied retrospectively.
Creatiminds may verify eligibility for scholarship or concession claims and may withdraw a benefit obtained through inaccurate information, while preserving the parent’s statutory rights.
6. Class Delivery, Scheduling and Attendance
Programs may be delivered online, offline, hybrid, recorded, project-based or through workshops. The delivery mode will be stated before enrollment. Parents are responsible for arranging a suitable device, stable internet connection and an appropriate learning environment for online sessions unless expressly included.
Learners should join on time, attend consistently and complete reasonable activities or assignments. Attendance requirements for certificates or projects will be disclosed for each program.
A learner’s absence does not require Creatiminds to refund the missed session. Where feasible, Creatiminds may offer a recording, recap, worksheet, make-up session or batch transfer, but these options are not guaranteed unless expressly included in the program.
If Creatiminds cancels a session, it will ordinarily reschedule the session, provide a suitable alternative, or apply the Refund Policy where the cancelled service cannot be delivered.
7. Parent Responsibilities
Parents and guardians agree to provide correct enrollment, emergency and contact information; communicate relevant learning, accessibility, allergy, medical or safety needs; ensure appropriate supervision for online access; and keep Creatiminds informed of changes.
Parents must not record, photograph or publicly share another child, parent, instructor, class screen, chat, project or personal information without permission.
Parents must communicate respectfully and raise concerns through official channels. Abuse, threats, harassment, public disclosure of children’s information, or disruption of classes may lead to restricted communication or other proportionate action.
Parents should review third-party platform age requirements and assist the child with any account that must legally be created or supervised by an adult.
8. Student Conduct and Community Standards
Learners must treat others respectfully and must not bully, threaten, discriminate, harass, impersonate, shame or deliberately exclude another person. They must not share inappropriate content, personal contact details, passwords, private images or recordings.
Learners must not disrupt sessions, damage property, bypass platform security, introduce malware, attempt unauthorised access, use another person’s account, or misuse chat, screen-sharing, collaborative documents or AI tools.
Creatiminds will respond to misconduct in an age-appropriate and proportionate manner, which may include a reminder, parent discussion, behaviour plan, temporary restriction, batch change, suspension or termination. Immediate restriction may be used where safety, abuse, serious harassment, illegal activity or material security risk is involved.
The Child Safeguarding and Online Safety Policy applies to all learners, parents, staff, instructors, volunteers and visitors.
9. Academic Integrity, Assessments and Certification
Assignments, projects and assessments should reflect the learner’s own effort, with reasonable parent or tool assistance disclosed where relevant. Copying another learner’s work, purchasing completed work, impersonation, unauthorised collaboration or misrepresenting AI-generated work as entirely original may lead to reassessment or refusal of certification.
Creatiminds may conduct a live explanation, project demonstration, oral review or additional task to verify learning. Any such process will be age-appropriate and conducted according to safeguarding rules.
Certificates may be described as participation, completion or achievement certificates. Unless expressly stated and supported by formal approval, a Creatiminds certificate is not a school-board qualification, university degree, government licence or regulated professional credential.
Eligibility may depend on attendance, project submission, conduct and assessment criteria disclosed for the program. Creatiminds may correct genuine certificate errors upon reasonable verification.
10. Responsible Use of Artificial Intelligence and Technology
Creatiminds may introduce age-appropriate AI tools, coding platforms, design tools or collaborative services. Parents will be informed when a third-party account or separate platform terms are materially required.
Learners must not enter private or sensitive information into AI systems, including full addresses, passwords, government identifiers, financial information, private school records, confidential family information or another person’s image without permission.
AI outputs may be inaccurate, biased, incomplete or inappropriate. Learners should verify important information, disclose meaningful AI assistance, and follow instructor guidance. Creatiminds does not guarantee the accuracy or continued availability of third-party AI tools.
Creatiminds will not intentionally use child data for behavioural advertising and does not permit learners to use technology for cyberbullying, impersonation, deepfakes, sexualised content, harmful instructions or unlawful activity.
11. Accounts, Passwords and Communications
Where an account is provided, the parent is responsible for maintaining account security and notifying Creatiminds promptly of suspected unauthorised access. Login credentials must not be sold, published or shared outside the enrolled household unless expressly permitted.
Official communications may be sent through email, phone, SMS, WhatsApp, learning platforms or other channels provided during enrollment. Marketing communications will include a reasonable opt-out method, but operational, safety, payment and class communications may continue where necessary to provide the service.
Instructors should not use private disappearing-message channels or personal social-media accounts for one-to-one communication with a child. Parent-inclusive and approved channels must be used, subject to the Safeguarding Policy.
12. Intellectual Property and Limited Learning Licence
The Creatiminds name, logo, curriculum, session plans, worksheets, videos, recordings, assessments, software, graphics, website text and original learning materials are owned by or licensed to Creatiminds and are protected by applicable intellectual-property laws.
Enrollment grants a limited, personal, non-exclusive, non-transferable and revocable licence to the enrolled learner and parent to use supplied materials for personal learning during the permitted access period. It does not permit resale, public distribution, uploading to shared drives, commercial tutoring, course replication, systematic copying or removal of ownership notices.
Learners retain ownership of their original projects, subject to rights in Creatiminds templates, prompts, examples and third-party assets. Creatiminds may display learner work internally for teaching and quality review. Public or promotional use that identifies a child requires appropriate parent consent.
Parents may report suspected infringement to the support email with sufficient details to identify the material and the concern.
13. Photographs, Videos, Recordings and Testimonials
Creatiminds may record certain classes for safety review, quality control, learner recap or instructor training where disclosed. Access, purpose and retention will be limited according to the Privacy and Child Data Policy.
Public use of a child’s identifiable photograph, video, voice, testimonial or project is governed by separate, optional media consent. Declining promotional media consent will not by itself prevent a child from participating in the core learning program.
Parents and learners must not independently publish recordings or images containing other participants without permission. Creatiminds may request removal of content that compromises child privacy, safety, intellectual property or confidentiality.
14. Third-Party Services and Links
The website or program may use third-party services such as payment gateways, video-conferencing platforms, cloud storage, email delivery, analytics, learning tools or embedded content. Those providers may apply their own terms and privacy practices.
Creatiminds selects providers with reasonable care but does not control all third-party outages, policy changes, content or security events. Where a third-party service becomes unsuitable, Creatiminds may replace it with a reasonably comparable service.
Links to external websites are provided for convenience or learning. A link does not necessarily mean endorsement, and parents should independently review suitability before allowing a child to access external content.
15. Educational Disclaimer and Outcomes
Creatiminds provides educational and skill-development services. Individual outcomes depend on attendance, effort, age, prior knowledge, home support, learning needs and other factors. Creatiminds does not guarantee marks, school admission, employment, income, competition results, personality transformation, public-speaking mastery or any fixed future outcome.
Examples, testimonials and learner stories describe individual experiences and must not be interpreted as typical or guaranteed results. Program content is not a substitute for medical, psychological, legal, financial or other regulated professional advice.
16. Health, Accessibility and Emergency Information
Parents should disclose information reasonably necessary for safe participation, such as allergies, mobility needs, emergency contacts or relevant accommodations. Creatiminds will limit access to such information and use it only for legitimate operational or safety purposes.
Creatiminds will consider reasonable accessibility and inclusion requests but may not be able to provide specialised medical, therapeutic or one-to-one support unless expressly agreed. The Accessibility and Inclusion Statement explains the request process.
For offline sessions, parents must comply with authorised pickup, arrival, departure, venue and emergency procedures communicated for the program.
17. Suspension, Termination and Service Refusal
Creatiminds may suspend or terminate access for non-payment, serious or repeated misconduct, safeguarding risk, fraud, misuse of content, security abuse, unlawful activity, or material breach of these Terms. Except where immediate safety action is necessary, Creatiminds will ordinarily communicate the concern and provide a reasonable opportunity to respond.
Where Creatiminds terminates a program for its own operational reasons unrelated to parent or learner breach, it will offer a reasonable alternative, credit or refund for the undelivered portion.
Where access is terminated because of a substantiated serious breach, refund entitlement will be assessed under the Refund Policy, services already delivered, costs committed and applicable law. Nothing in these Terms removes mandatory consumer rights.
18. Availability, Changes and Force Majeure
Creatiminds aims to keep services available but does not promise uninterrupted access. Maintenance, internet failure, instructor illness, venue restrictions, public emergencies, natural events, government orders, platform outages or circumstances beyond reasonable control may cause delay or change.
Creatiminds will make reasonable efforts to reschedule or provide alternatives. Where a material part of the service cannot be delivered, the Refund Policy will apply.
Material policy changes will be posted with an updated date and, where reasonably practicable, communicated to enrolled parents. Changes will not retrospectively remove accrued statutory rights.
19. Liability and Consumer Rights
To the maximum extent permitted by law, Creatiminds is not liable for indirect or consequential loss, loss caused by inaccurate information supplied by the parent, misuse of third-party platforms, unauthorised sharing of credentials, or events beyond reasonable control.
Nothing in these Terms excludes liability that cannot legally be excluded, including liability arising from fraud, wilful misconduct, gross negligence, breach of mandatory child-safety obligations, or statutory consumer rights.
Any limitation will be interpreted fairly and in accordance with applicable law. Parents remain entitled to remedies available under consumer, data-protection and other applicable laws.
20. Complaints, Governing Law and Jurisdiction
Questions and complaints may be sent to hello@creatiminds.com. Complaints will be handled under the Grievance Redressal Policy.
These Terms are governed by the laws of India. Subject to mandatory consumer forums, statutory authorities and other non-waivable remedies, courts at Pune, Maharashtra will have jurisdiction.
Before starting formal proceedings, the parties should attempt good-faith resolution through the grievance process. This does not prevent urgent safeguarding reports or access to statutory remedies.
